Terms of Service

These Terms of Service ("Terms") govern your access to and use of ServerVisor, a website monitoring service operated by ServerVisor LLC ("we," "us," or "our"). By creating an account or using ServerVisor, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

ServerVisor provides uptime monitoring, SSL certificate monitoring, domain expiry monitoring, heartbeat monitoring, and server performance monitoring ("Node Insights"). We check your configured endpoints at the intervals specified by your subscription plan and alert you when we detect problems.

Monitoring intervals

Check intervals (e.g. "1-minute monitoring") are approximate. Actual intervals may vary due to network conditions and system load. A nominally 1-minute check may run anywhere between 40 and 90 seconds in practice. ServerVisor is designed to detect sustained outages, not instantaneous sub-minute blips.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

You must be at least 18 years old to use ServerVisor. By creating an account you represent that you meet this requirement and have the authority to bind any organisation on whose behalf you are registering.

3. Subscriptions and Billing

ServerVisor is offered on a subscription basis. Paid plans are billed in advance, monthly or annually, via Stripe. All prices are in US dollars and exclude any applicable taxes, which are your responsibility.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for unused portions of a billing period except where required by applicable law.

Plan changes

Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing period. We reserve the right to change pricing with at least 30 days' notice; continued use after the effective date constitutes acceptance of the new pricing.

Failed payments

If a payment fails, we will retry it according to our payment processor's schedule. If payment remains outstanding after the retry period, we may suspend your account until payment is received. Suspended accounts retain data for 30 days before deletion.

4. Acceptable Use

You agree not to use ServerVisor to:

  • Monitor endpoints you do not own or have explicit permission to monitor
  • Conduct load testing, stress testing, or any form of attack against monitored targets
  • Attempt to reverse-engineer, scrape, or extract data from the ServerVisor platform
  • Resell or sublicense access to the service without our written consent
  • Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these rules without notice.

5. Service Availability

We aim to keep ServerVisor available and running reliably, but we do not guarantee uninterrupted service. The monitoring platform itself may experience downtime for maintenance, infrastructure issues, or reasons beyond our control.

Important

If ServerVisor is unavailable, monitoring checks will not run during that period. We will not send alerts for outages that occur while our own service is down, and you will not be credited for monitoring time lost during ServerVisor outages unless we publish a specific credit policy for that incident.

We maintain a public status page at status.servervisor.io where we communicate planned maintenance windows and active incidents.

6. Data Retention

We retain different categories of data for different periods:

  • Uptime check history and response time data: retained for the number of days specified by your plan (typically 30–365 days depending on tier)
  • Heartbeat ping history: retained for 90 days
  • Incident records and alert history: retained for 12 months
  • Account and billing information: retained for the life of your account plus 7 years for tax and legal compliance
  • Server performance metrics (Node Insights): retained for 30 days on the standard tier

When you delete your account, we begin deletion of your monitoring data within 30 days. Billing records and legally required information are retained for the periods required by law.

7. Intellectual Property

ServerVisor and all content, features, and functionality of the service are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of the service without our written consent.

You retain ownership of any data you provide to the service, including your monitor configurations, alert settings, and account information. You grant us a limited licence to store and process that data solely to provide the service to you.

8. Disclaimer of Warranties

ServerVisor is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, that all outages affecting your monitored endpoints will be detected, or that alerts will be delivered within any particular time frame.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business, arising out of or in connection with your use of ServerVisor, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ServerVisor LLC, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

Either party may terminate these Terms at any time. You may terminate by cancelling your subscription and deleting your account. We may terminate or suspend your account immediately for violation of these Terms, non-payment, or for any other reason with reasonable notice where practicable.

Sections covering intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law survive termination.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the dashboard at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
